Understanding age discrimination and acting against it

Workers over 40 may encounter age discrimination in the workplace, manifesting through offensive remarks, discriminatory policies, or unfair treatment. The Age Discrimination in Employment Act (ADEA) is the primary federal law that protects older workers from unfair treatment based on age.

This protection covers various employment aspects, including hiring, promotions, conditions, and termination. Understanding how age discrimination occurs and navigating these claims is crucial for employees and employers to ensure a fair workplace.

Harassment

Age discrimination does not only manifest in hiring or firing decisions; it can also appear as harassment. Harassment includes offensive remarks about a person’s age, creating a hostile work environment.

While casual jokes might seem harmless, frequent or severe comments can lead to legal issues. Both federal and state laws, including those in Rhode Island and Massachusetts, prohibit such harassment.

Discriminatory practices

Employment policies and practices must also be free from age bias. Even a policy that applies to everyone can be illegal if it disproportionately affects workers over 40 and lacks a reasonable justification unrelated to age.

For example, setting arbitrary physical fitness requirements that older workers cannot meet without a valid reason might be discriminatory. Employers should ensure their practices are fair and based on job performance, not age.

Acting against age discrimination

If you believe you’ve experienced age discrimination, document the incidents and report them to the HR department. If the situation or problem is not resolved, you can file a complaint with the Equal Employment Opportunity Commission (EEOC).
